{"id":29404,"date":"2026-04-06T09:23:04","date_gmt":"2026-04-06T09:23:04","guid":{"rendered":"https:\/\/alstud.org.tr\/?p=29404"},"modified":"2026-04-06T09:23:04","modified_gmt":"2026-04-06T09:23:04","slug":"saglikta-sinirlar-yeniden-cizildi-torba-yasayla-yapilan-onemli-degisiklikler-nelerdir","status":"publish","type":"post","link":"https:\/\/alstud.org.tr\/en\/saglikta-sinirlar-yeniden-cizildi-torba-yasayla-yapilan-onemli-degisiklikler-nelerdir\/","title":{"rendered":"Sa\u011fl\u0131kta S\u0131n\u0131rlar Yeniden \u00c7izildi: Torba Yasayla Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler Nelerdir?"},"content":{"rendered":"<p class=\"wp-block-wd-paragraph wd-f26821ab\">Sa\u011fl\u0131k sekt\u00f6r\u00fcn\u00fcn hizmet sunum bi\u00e7iminden dijitalle\u015fme ad\u0131mlar\u0131na, hekimlerin \u00e7al\u0131\u015fma haklar\u0131ndan \u00f6zel sa\u011fl\u0131k kurulu\u015flar\u0131n\u0131n tan\u0131t\u0131m s\u0131n\u0131rlar\u0131na kadar bir\u00e7ok alanda de\u011fi\u015fiklik getiren 21 Temmuz 2025 tarihli torba yasa, sekt\u00f6rde bir yeniden yap\u0131lanma s\u00fcrecini ba\u015flatm\u0131\u015f durumda. \u00d6zellikle sa\u011fl\u0131k turizmiyle i\u00e7 i\u00e7e \u00e7al\u0131\u015fan kurulu\u015flar\u0131, bu de\u011fi\u015fiklikleri sadece birer yasal madde olarak de\u011fil, ayn\u0131 zamanda hizmet modellerini etkileyen stratejik ba\u015fl\u0131klar olarak g\u00f6rmesi gerekiyor. <\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-3180bf02\"><strong>Hekimlere En Fazla \u0130ki \u00d6zel Kurumda \u00c7al\u0131\u015fma Hakk\u0131<\/strong><\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-d978383d\">Yasan\u0131n en \u00e7ok dikkat \u00e7eken d\u00fczenlemelerinden biri, 11\/4\/1928 tarihli ve 1219 say\u0131l\u0131 Tababet ve \u015euabat\u0131 San\u2019atlar\u0131n\u0131n Tarz\u0131 \u0130cras\u0131na Dair Kanun\u2019un 12. maddesinde yap\u0131lan de\u011fi\u015fiklikle geldi. Daha \u00f6nce \u201cbirden fazla\u201d yerde \u00e7al\u0131\u015fabilen tabipler i\u00e7in art\u0131k \u201cen fazla iki\u201d \u00f6zel sa\u011fl\u0131k kurulu\u015funda \u00e7al\u0131\u015fma hakk\u0131 tan\u0131mland\u0131. Ayn\u0131 d\u00fczenlemede yap\u0131lan eklemeyle birlikte, kamu s\u00f6zle\u015fmesi olsun olmas\u0131n, tabipler ile di\u015f tabipleri ve uzmanlar \u00f6zel sa\u011fl\u0131k kurulu\u015flar\u0131nda 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2019nun 4\/a maddesi kapsam\u0131nda sigortal\u0131 olarak \u00e7al\u0131\u015fabilecek. Bu durum, kay\u0131t d\u0131\u015f\u0131 istihdam\u0131n \u00f6n\u00fcne ge\u00e7ilmesini hedeflerken; \u00f6zellikle sa\u011fl\u0131k turizmine hizmet veren kurulu\u015flar\u0131n hekim istihdam\u0131nda kurumsal ve denetlenebilir yap\u0131lar kurmas\u0131n\u0131 zorunlu k\u0131l\u0131yor. Klinikler a\u00e7\u0131s\u0131ndan bak\u0131ld\u0131\u011f\u0131nda, kadro planlamalar\u0131nda sigorta uyumuna dikkat etmek ve s\u00f6zle\u015fme say\u0131lar\u0131n\u0131 d\u00fczenlemek art\u0131k yaln\u0131zca tercih de\u011fil, yasal bir y\u00fck\u00fcml\u00fcl\u00fck h\u00e2line geldi.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-2f20ada2\"><strong>Tan\u0131t\u0131m Faaliyetlerinde Yeni S\u0131n\u0131rlar ve Dijital \u0130\u00e7erik K\u0131s\u0131tlamalar\u0131<\/strong><\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-eec917f0\">Tan\u0131t\u0131m faaliyetlerine ili\u015fkin getirilen s\u0131n\u0131rland\u0131rmalar ise do\u011frudan sa\u011fl\u0131k hizmetlerinin dijital ortamlardaki g\u00f6r\u00fcn\u00fcrl\u00fc\u011f\u00fcn\u00fc ilgilendiriyor. 7\/5\/1987 tarihli ve 3359 say\u0131l\u0131 Sa\u011fl\u0131k Hizmetleri Temel Kanunu\u2019nun ek 11. maddesine eklenen yeni f\u0131krayla birlikte, \u00f6zel sa\u011fl\u0131k kurulu\u015flar\u0131n\u0131n tan\u0131t\u0131m ve bilgilendirme s\u0131n\u0131r\u0131n\u0131 a\u015fan reklam niteli\u011findeki faaliyetleri a\u00e7\u0131k\u00e7a yasakland\u0131. Yeni d\u00fczenlemeye g\u00f6re bir sa\u011fl\u0131k kurulu\u015fu yaln\u0131zca adresi, ileti\u015fim bilgileri, \u00e7al\u0131\u015fma saatleri, hasta kabul etti\u011fi uzmanl\u0131k dallar\u0131, kadrosundaki sa\u011fl\u0131k profesyonellerinin akademik ve mesleki unvanlar\u0131 ve koruyucu sa\u011fl\u0131k bilgileriyle s\u0131n\u0131rl\u0131 i\u00e7erikler sunabilecek. Bu s\u0131n\u0131rlar\u0131 a\u015fan, yan\u0131lt\u0131c\u0131 ya da haks\u0131z rekabet yaratan faaliyetlerde bulunan kurulu\u015flara ise bir \u00f6nceki aya ait br\u00fct hizmet gelirinin %2\u2019sine kadar, ancak en az y\u00fcz bin T\u00fcrk liras\u0131 tutar\u0131nda idari para cezas\u0131 uygulanacak. Sa\u011fl\u0131k hizmetlerinin bir \u201c\u00fcr\u00fcn\u201d gibi pazarlanmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7meyi ama\u00e7layan bu madde, \u00f6zellikle sosyal medya ve dijital reklam \u00fczerinden hasta kazan\u0131m\u0131 sa\u011flamaya \u00e7al\u0131\u015fan sa\u011fl\u0131k turizmi akt\u00f6rlerinin i\u00e7erik stratejilerini g\u00f6zden ge\u00e7irmesini gerekli k\u0131l\u0131yor.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-77fe1012\"><strong>Lisans ve Ruhsatlar \u0130\u00e7in \u00dccretlendirme ve A\u00e7\u0131k Art\u0131rma Sistemi<\/strong><\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-f4a2fb1f\">Yat\u0131r\u0131m s\u00fcre\u00e7lerini ilgilendiren en \u00f6nemli de\u011fi\u015fiklik ise MADDE 57 ile birlikte y\u00fcr\u00fcrl\u00fc\u011fe girdi. Art\u0131k Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 ve ba\u011fl\u0131 kurulu\u015flar taraf\u0131ndan verilen ruhsatlar, sertifikalar, permi belgeleri gibi dok\u00fcmanlar i\u00e7in iki milyon T\u00fcrk liras\u0131n\u0131 ge\u00e7memek \u00fczere belirlenen tarifelere g\u00f6re \u00fccret al\u0131nabilecek. Ayr\u0131ca hastane a\u00e7ma veya belirli bir hizmeti verme hakk\u0131 sa\u011flayan lisanslar a\u00e7\u0131k art\u0131rma ile belirlenecek bedel kar\u015f\u0131l\u0131\u011f\u0131nda verilecek. Bu sistem, lisanslar\u0131n planl\u0131 \u015fekilde da\u011f\u0131t\u0131lmas\u0131n\u0131 sa\u011flarken; sekt\u00f6re girmek isteyen yat\u0131r\u0131mc\u0131lar\u0131n mali planlamalar\u0131n\u0131 daha \u00f6ng\u00f6r\u00fclebilir k\u0131lacak. Elde edilen lisans gelirlerinin %75\u2019i, \u00fclkemizin sa\u011fl\u0131k turizmini d\u00fcnyaya tan\u0131tmakla g\u00f6revli olan Uluslararas\u0131 Sa\u011fl\u0131k Hizmetleri A.\u015e. (USHA\u015e)\u2019a aktar\u0131lacak.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-a19d072d\"><strong>Hasta Onam S\u00fcre\u00e7lerinin Dijitalle\u015fmesi ve E-\u0130mza D\u00f6nemi<\/strong><\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-3be80c81\">Bir di\u011fer dikkat \u00e7eken ba\u015fl\u0131k ise hasta onam s\u00fcre\u00e7lerinin dijital ortama ta\u015f\u0131nmas\u0131yla ilgili. 1219 say\u0131l\u0131 Kanun\u2019un 70. maddesine eklenen yeni f\u0131kra sayesinde, art\u0131k hasta muvafakatnameleri biyometrik y\u00f6ntemlerle, mobil cihazlar ya da e-imza uygulamalar\u0131yla elektronik ortamda al\u0131nabilecek. Bu yenilik, \u00f6zellikle yurt d\u0131\u015f\u0131 hastalar\u0131yla \u00f6n g\u00f6r\u00fc\u015fme yapan sa\u011fl\u0131k kurulu\u015flar\u0131n\u0131n, onam belgelerini daha h\u0131zl\u0131 ve hukuka uygun \u015fekilde dijitalle\u015ftirmesinin \u00f6n\u00fcn\u00fc a\u00e7\u0131yor. Bu sistemin usul ve esaslar\u0131 ise Bilgi Teknolojileri ve \u0130leti\u015fim Kurumu\u2019nun (BTK) uygun g\u00f6r\u00fc\u015f\u00fc al\u0131narak Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 taraf\u0131ndan belirlenecek. D\u00fczenlemeye ayk\u0131r\u0131 hareket eden sa\u011fl\u0131k kurulu\u015flar\u0131na 250 TL idari para cezas\u0131 uygulanacak olmas\u0131, t\u00fcm kurulu\u015flar\u0131n hasta ileti\u015fim s\u00fcre\u00e7lerinde dijital uyumlar\u0131n\u0131 art\u0131rmalar\u0131n\u0131 zorunlu k\u0131l\u0131yor.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-64af5f2b\"><strong>Genel De\u011ferlendirme<\/strong><\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-24550f9d\">Yeni torba yasa ile getirilen d\u00fczenlemeler, sa\u011fl\u0131k turizmi sekt\u00f6r\u00fcn\u00fc yaln\u0131zca yasal uyuma zorlam\u0131yor; ayn\u0131 zamanda sekt\u00f6rel kimli\u011fini yeniden tan\u0131mlamaya itiyor. Bu de\u011fi\u015fikliklerin etkilerini yaln\u0131zca mevzuat a\u00e7\u0131s\u0131ndan de\u011fil, hizmet stratejileri, hasta ili\u015fkileri ve uluslararas\u0131 rekabet g\u00fcc\u00fc ba\u011flam\u0131nda ele almak gerekiyor.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-54d3a118\">Olumlu y\u00f6nlerden bak\u0131ld\u0131\u011f\u0131nda, hekimin sigortal\u0131 ve kurumsal yap\u0131lar i\u00e7inde \u00e7al\u0131\u015fmas\u0131n\u0131n zorunlu hale gelmesi, uluslararas\u0131 hastalar i\u00e7in \u201cg\u00fcvenli hizmet\u201d alg\u0131s\u0131n\u0131 peki\u015ftirecek; denetimle desteklenen bu yap\u0131, etik standartlar\u0131n y\u00fckselmesini sa\u011flayacakt\u0131r. Ayr\u0131ca dijital onam sistemlerinin devreye girmesi, \u00f6zellikle yurt d\u0131\u015f\u0131 hastalarla yap\u0131lan \u00f6n g\u00f6r\u00fc\u015fmelerde h\u0131z ve g\u00fcvenlik a\u00e7\u0131s\u0131ndan b\u00fcy\u00fck bir avantaj sunacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-cc06deea\">Ancak bu reformlar, \u00f6zellikle k\u00fc\u00e7\u00fck ve orta \u00f6l\u00e7ekli klinikler a\u00e7\u0131s\u0131ndan baz\u0131 uyum s\u00fcre\u00e7lerini beraberinde getirebilir. Hekim \u00e7al\u0131\u015fma hakk\u0131n\u0131n iki kurumla s\u0131n\u0131rland\u0131r\u0131lmas\u0131, \u00f6zellikle doktor havuzunun s\u0131n\u0131rl\u0131 oldu\u011fu b\u00f6lgelerde planlama konusunda dikkatli ve \u00f6nleyici ad\u0131mlar at\u0131lmas\u0131n\u0131 gerektirebilir. Benzer \u015fekilde, tan\u0131t\u0131m faaliyetlerine getirilen s\u0131n\u0131rlar\u0131n dijital pazarlama al\u0131\u015fkanl\u0131klar\u0131n\u0131 de\u011fi\u015ftirece\u011fi a\u00e7\u0131kt\u0131r. Bu durum, y\u0131llard\u0131r sosyal medya \u00fczerinden hasta ileti\u015fimi kuran sa\u011fl\u0131k turizmi firmalar\u0131n\u0131n stratejilerini yeniden \u015fekillendirmesini zorunlu k\u0131lmakla birlikte, i\u00e7erik \u00fcretiminde etik, bilgilendirici ve fark\u0131ndal\u0131k odakl\u0131 yakla\u015f\u0131mlar\u0131n \u00f6ne \u00e7\u0131kmas\u0131na da zemin haz\u0131rlayabilir. Bu ge\u00e7i\u015f s\u00fcrecinde hasta say\u0131lar\u0131nda k\u0131sa vadeli dalgalanmalar ya\u015fanmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-7f381874\">Lisanslar\u0131n \u00fccretli ve a\u00e7\u0131k art\u0131rma usul\u00fcyle verilmesi ise pazara yeni girecek yat\u0131r\u0131mc\u0131lar i\u00e7in ciddi bir mali e\u015fik olu\u015fturabilir. Bu noktada sekt\u00f6r\u00fcn devlet destekleriyle bu ge\u00e7i\u015fi daha s\u00fcrd\u00fcr\u00fclebilir k\u0131lmas\u0131 ka\u00e7\u0131n\u0131lmazd\u0131r. Ayn\u0131 zamanda elde edilecek gelirlerin USHA\u015e \u00fczerinden sa\u011fl\u0131k turizmine aktar\u0131lmas\u0131, do\u011fru planlama ile sekt\u00f6re uzun vadeli g\u00fc\u00e7 kazand\u0131rabilir.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-4ebbb764\">Sonu\u00e7 olarak, bu torba yasa sadece bir uyum s\u00fcreci de\u011fil; sa\u011fl\u0131k turizminde \u201cyeniden pozisyon alma\u201d s\u00fcrecidir. Kliniklerin sadece kurallara uymas\u0131 de\u011fil, bu kurallar\u0131 bir kalite zeminine d\u00f6n\u00fc\u015ft\u00fcrmesi gerekmektedir. Alanya gibi sa\u011fl\u0131k turizmi a\u00e7\u0131s\u0131ndan \u00f6ne \u00e7\u0131kan b\u00f6lgeler i\u00e7in bu d\u00f6nem, k\u0131sa vadede zorluk bar\u0131nd\u0131rsa da uzun vadede itibar, kalite ve s\u00fcrd\u00fcr\u00fclebilirlik a\u00e7\u0131s\u0131ndan f\u0131rsatlar sunmaktad\u0131r.
